Terms of Service
The short version
River is a free Texas Hold’em game played with play-money chips. Chips have no monetary value. You can’t buy them, sell them or cash them out, there are no prizes, and River is not gambling. You must be 18 or older. Play fair: no cheating, collusion, bots or chip trading. We may reset chips, and we may close accounts that break these rules. River is provided as is, and our liability is limited to US$50.
1. Agreement and scope
These Terms are an agreement between you and GitSwift LLC, 30 North Gould Street, Suite R, Sheridan, WY 82801, United States (“GitSwift”, “we”, “us”). They cover the River app for iPhone, the River online service (accounts, rooms, friends, leaderboards and Inbox) and these web pages, together “River”. By creating an account or using River you accept these Terms and our Privacy Policy. If you don’t accept them, please don’t use River.
You get River from the App Store, so Apple’s Licensed Application End User License Agreement also applies. These Terms are between you and GitSwift, not Apple. Apple is not responsible for River or its content, has no obligation to provide maintenance or support for it, and is not responsible for handling any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. What River is, and is not
River lets you play no-limit Texas Hold’em against computer opponents on your iPhone, and in private online rooms with friends and other players. It is played for fun, with play-money chips only.
- River is not gambling. Nothing of monetary value is wagered, won or lost.
- There are no purchases. You can’t buy chips or anything else in River.
- There is no cash-out and there are no prizes. Chips can’t be exchanged or redeemed for money, goods, services or anything else of value, and leaderboards carry no rewards.
- Practice or success in River does not mean you will succeed at real-money poker or gambling.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live if that is higher, and able to enter into a binding contract. Don’t use River where doing so is against the law.
4. Your account
- You can sign up with an email address and password, or with Sign in with Apple. Give accurate information and keep your password secure.
- One account per person. You are responsible for activity on your account. Tell us at support@gitswift.com if you think someone else has used it.
- Your username and the names of rooms you create must not impersonate anyone, infringe anyone’s rights, or be offensive, hateful or sexually explicit. We may change or reclaim names that break this rule.
- You may not sell, transfer or share your account.
5. Chips
- Chips are virtual, play-money items with no monetary value. They aren’t your property. We give you a limited, personal, revocable license to use them inside River.
- New accounts start with free chips, and River offers more free chips from time to time. Amounts and schedules may change.
- We may reset, adjust or remove chip balances, statistics and leaderboards at any time. For example, we may do this to fix bugs or errors, reverse chips gained through cheating or exploits, rebalance the game, or move to new systems. Because chips have no value, no compensation is owed.
- Chips move between players only through normal play at a table. Buying, selling, trading or giving away chips or accounts is not allowed, whether in River or elsewhere.
6. Redeem codes
We may publish codes that add chips to your account. Each code can be redeemed once per account. Codes have no monetary value, can’t be sold or exchanged, and may be changed, limited or withdrawn at any time. A code entered while you’re offline is checked when the app next connects and is never granted twice. We may void codes obtained or used in breach of these Terms, for example through extra accounts, and remove the chips they added.
7. Fair play and acceptable use
You agree not to:
- cheat, including by using bots, scripts or other software, or other people, to play for you or advise you in real time during a hand (River’s built-in hints are fine);
- collude with other players, for example by sharing hole cards, soft-playing, or deliberately losing chips to another player;
- trade chips: buy, sell or trade chips or accounts, or offer or accept anything of real-world value in connection with River;
- create or use multiple accounts to collect free chips or redeem codes, or to affect leaderboards;
- use River for real-money games or to settle bets made outside River;
- exploit bugs (please report them to us instead);
- interfere with River, for example by overloading, probing or scanning our servers, getting around rate limits, or accessing accounts or data that aren’t yours;
- harass, threaten or abuse other players; or
- break any law while using River.
You can block any player and report a player from their profile or from a seat at a table. Blocked players can’t send you friend requests or invitations, see whether you’re online, or sit at or watch a table you’re hosting or playing at. We review reports and may act on them as described in section 12. We don’t tell a reported player who reported them.
8. Multiplayer rooms
Our server deals every hand and decides every timer and result. If you run out of time or lose your connection, the server may check or fold for you, sit you out, and eventually remove you from the table, returning your stack to your balance. If a hand is interrupted by a server restart or fault, it may be cancelled and stacks returned to what they were before the hand. The host of a room can close it at any time, and every seated player’s chips are then returned to their balance.
9. Availability and changes to River
We work to keep River running well, but we don’t promise that it will always be available, uninterrupted or error-free. We may change, suspend or stop any part of River at any time, including features, chip amounts and the online service. If we plan to shut down the online service, we will try to give reasonable notice in the app.
10. Third-party services
River relies on services we don’t control, including Apple (the App Store and Sign in with Apple), our hosting and email providers, and your internet connection. Their own terms govern how you use them, and we are not responsible for them.
11. Intellectual property
River, including its software, design, text, graphics and sounds, belongs to GitSwift LLC and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use River for your own non-commercial entertainment under these Terms. You may not copy, modify, distribute, sell or reverse engineer River, except where the law expressly allows it. Open-source components remain under their own licenses. If you send us feedback, we may use it without any obligation to you.
12. Termination
You can stop using River at any time and delete your account in the app under Settings → Delete account. We may suspend or close your account, reset its chips or remove it from leaderboards if you break these Terms, if the law requires it, or to protect River or its players. We may do so with or without notice. When your account ends, your license ends and your chips are forfeited without compensation. Sections 5, 6, 11, 13, 14 and 15 survive termination.
13. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVER AND THESE WEB PAGES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
We don’t promise that River will be uninterrupted or error-free, that game data or chip balances will never be lost, or that the AI opponents will play in any particular way. Some jurisdictions don’t allow implied warranties to be excluded, so some of these exclusions may not apply to you.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GITSWIFT LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CHIPS, USE OR GOODWILL, ARISING FROM OR RELATED TO RIVER OR THESE TERMS.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO RIVER OR THESE TERMS IS LIMITED TO FIFTY US DOLLARS (US$50). RIVER HAS NO PAID FEATURES.
These limits don’t apply to liability that the law doesn’t allow us to exclude or limit. That includes liability for gross negligence, willful misconduct, or death or personal injury caused by negligence. It also includes your statutory rights as a consumer.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute relating to River or these Terms will be resolved exclusively in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. If you are a consumer and the law of your country gives you the right to rely on its consumer protections or to bring claims in your local courts, these Terms don’t take that right away. Before starting any legal claim, please contact us at support@gitswift.com so we can try to resolve it informally.
16. Changes to these Terms
We may update these Terms as River changes. The effective date at the top shows the current version. We’ll make significant changes clear in the app or on this page before they take effect. If you keep using River after a change takes effect, you accept the updated Terms.
